SELC, for the NAACP and Young, Gifted & Green, appealed the July 2025 permit to the Memphis & Shelby County Air Pollution Control Board, arguing the turbines are a major Clean Air Act source in a smog-nonattainment area that was never properly permitted. No EPA penalty assessed as of June 2026.
