At least 46 unpermitted natural-gas turbines (~500 MW) operating as a major source with no PSD preconstruction or Title V permit. NAACP v. xAI Holdings LLC & MZX Tech LLC was filed 2026-04-14 in the U.S. District Court for the Northern District of Mississippi (SELC + Earthjustice), seeking an injunction, Best Available Control Technology, and per-day civil penalties. On 2026-04-15 Sen. Sheldon Whitehouse (EPW Ranking Member) pressed EPA on its non-enforcement. EPA had taken no formal action and assessed no penalty as of June 2026.
